Cancellation of the reservation

We present the contractual document that will govern the contracting of products and services through the website https://barcelonaartoftravel.com owned by Made in Solidarity SCCL (hereinafter the provider or BarcelonArt of Travel). Acceptance of this document implies that the user:

  1. You have read, understand and comprehend what is stated here.
  2. That he is a person with sufficient capacity to hire.
  3. That it assumes all the obligations set forth herein.

These terms and conditions will be valid for an indefinite period and will be applicable to all contracts made through the provider’s website https://barcelonaartoftravel.com. IMPORTANT: The provider reserves the right to unilaterally modify these Conditions, without affecting the goods or promotions that were purchased prior to the modification. On the other hand, unless otherwise indicated, contacts by telephone or fax/modem will have the same costs as local calls, so they will not incur a cost higher than the basic tariff. Identity of the parties

On the one hand, the supplier of the goods or services contracted by the user is Made in Solidarity SCCL, with registered office at C/ Valencia 264, 08007 Barcelona, NIF F65631384. The user, whether registered or not on the website, is responsible for the veracity of the personal data provided to the provider.

Object of the Contract

The purpose of this contract is to regulate the contractual relationship of purchase and sale arising between the provider and the user at the time when the latter accepts the corresponding box during the online contracting process. The contractual relationship of sale entails the delivery, in exchange for a specific price and publicly displayed through our website, of a specific product or service.

Recruitment procedure

The contracting procedure may only be carried out in the Spanish language. In the event that it could be carried out in another language, it will be indicated before starting the contracting procedure. In order to access the services offered by the provider, the user must register through the website by creating a user account. To do so, the user must freely and voluntarily provide the personal data that will be required. The user will select a username and password, undertaking to make diligent use of them, and not to make them available to third parties, as well as to notify the provider of the loss or theft of the same or of possible access by an unauthorized third party, in such a way that the latter proceeds to the immediate blocking. The user may not choose as a username words that are intended to confuse others by identifying the user as an integral member of the provider, as well as rude, insulting expressions and, in general, contrary to the law or the requirements of morality and good customs. Once the user account has been created, you are informed that in accordance with the requirements of article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:

In any case, the provider’s contracting platform will inform the user, once the contracting procedure has been completed, regarding all the characteristics, price, forms of transport, date of contracting and estimated delivery of the contracted product or service. Likewise, an e-mail will be sent to the user confirming their order. Adequate access to the online store depends on the telecommunications system used and in particular on the internet network, so the Company is not responsible for interruptions, delays or errors in the service due to causes beyond its control, as well as those derived from the Client’s equipment and/or connection to the network.

Order Delivery

Orders will be delivered to the address freely designated by the user. In the event that at the time of receipt of your order one or more of the products or services in your order are not available or are out of stock, unfortunately it will not be possible to fulfill your order completely. In this case, we reserve the right to choose between partial fulfillment of your order and complete rejection. In this case, we will inform you immediately by e-mail. The provider does not assume any responsibility for when the delivery of the product or service is not carried out as a result of the data provided by the user being false, inaccurate or incomplete or when the delivery cannot be made for reasons beyond the control of the shipping company, assigned for this purpose, such as the absence of the recipient. Notwithstanding the foregoing, the service provider must take the measures required of a diligent trader so that the delivery can be made within the agreed time, and if not, as soon as possible, to the satisfaction of both the sender and the recipient, so that no liability can be attributed to the provider.

Price and validity period of the offer

All the prices indicated for the goods in the online shop are understood to include the current value added tax and any charges that may be applicable, and in any case will be expressed in the Euro currency (€). The prices applicable to each product/service will be those published on the website and will be applied automatically by the contracting process in the last phase of the same. The customer assumes that in any case the economic valuation of some of the products may vary in real time. In any case, this will always be communicated in advance to the users. Any payment made to the provider will entail the issuance of an invoice in the name of the registered user at the end of the purchase process. This invoice may be automatically sent to the email address provided by the user, as well as sent together with the purchased product, when the user needs it. In any case, the order number assigned to you and indicated in the purchase confirmation email must be indicated in the subject of the message or to the telephone operator.

Payment methods

As for the reservation of title, until the full price is paid, the goods delivered will remain the property of BarcelonArt of Travel. The payment will be made in advance with PayPal (Prior registration, your bank or credit card details are deposited with this company). We inform you that, depending on the conditions you have stipulated with credit institutions or other institutions, you may incur additional costs for transfer fees, account management, etc. We recommend that you check with your bank or credit card company about this. The provider undertakes and agrees that at no time will any charge be made for the use of the aforementioned payment method. We reserve the right to restrict the use of the above payment methods to one or more options on an individual basis. We use secure payment systems from leading financial institutions in e-commerce. Payment data is confidential and transmitted in encrypted form (SSL) to the respective financial institution. Payment by credit card has an order processing time of 48 hours.

Right of withdrawal

The user will have a period of 14 calendar days from the date of receipt of the product to return it. In the event that it is not possible for the buyer to return the services received in whole or in part, or only in a deteriorated state, the buyer is obliged to compensate BarcelonArt of Travel to the corresponding extent.

Applicable Warranties

All of them have the warranty period in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of November 16, 2007, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

Data protection

The person responsible for the online store for the purposes of the regulations on the protection of personal data and the regulations on e-commerce is BarcelonArt of Travel. We will use your data only in the terms provided for by law and based on your consent; This is particularly true for data relating to the receipt and fulfilment of your order (e.g. name, address, e-mail address, information on things ordered/purchased, data on your ordering and payment behaviour) as well as any other data that you voluntarily provide to us.

Governing Law and Jurisdiction

These conditions shall be governed or interpreted in accordance with Spanish law to the extent that it is not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these Terms and Conditions to the Courts and Tribunals of the Province: Barcelona.
