GENERAL CONTRACTING CONDITIONS

We expose the contractual document by which the contracting of products and services through the website https://barcelonaartoftravel.com property of Made in Solidarity SCCL (hereinafter the provider or BarcelonArt of Travel) will be governed. The acceptance of this document implies that the user:

  1. Has read, understands, and understands what is set forth herein.
  2. That he/she is a person with sufficient capacity to contract.
  3. That he/she assumes all the obligations set forth herein.

These conditions shall be valid for an indefinite period of time and shall be applicable to all contracts made through the provider’s website https://barcelonaartoftravel.com. IMPORTANT: The provider reserves the right to unilaterally modify these Conditions, without affecting the goods or promotions that were purchased prior to the modification. Furthermore, unless otherwise indicated, contacts by telephone or fax/modem will have the same costs as local calls, so they will not cost more than the basic rate. IMPORTANT: By Law 12/2003 of November 24, 2003, for the reform of Law 4/1997 of July 9, 1997, on Drug Prevention and Assistance, modified by Law 1/2001 of May 3, 2001, article 1 prohibits the sale or supply to minors under 18 years of age. Said prohibition is excluded when the sale or supply to those over 16 years of age is accredited for professional use of the product. In the second case, they must legally notify BarcelonArt of Travel by any means of accreditation of such evidence. IMPORTANT: In compliance with the current regulations of the card brands:

“This merchant agrees not to allow any transaction that is illegal, or is deemed by the credit card brands or acquiring bank, that may or has the potential to damage the goodwill of, or negatively influence them. The following activities are prohibited under the card brands’ programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Purchaser, Issuing Bank, Merchant, Cardholder, or cards.”

Identity of the parties

On the one hand, the supplier of the goods or services contracted by the user is Made in Solidarity SCCL, with registered office Ave. República Argentina 277 PB 1ª, Barcelona 08023(Barcelona, Spain), NIF F65631384. The user, whether registered or not on the website, being responsible for the accuracy of the personal data provided to the provider.

Object of the Contract

The purpose of this contract is to regulate the contractual relationship of purchase and sale born between the provider and the user at the time the user accepts during the online contracting process the corresponding box. The contractual relationship of purchase and sale entails the delivery, in exchange for a determined price and publicly exposed through our website, of a specific product or service.

Contracting procedure

The contracting procedure can only be carried out in the Spanish language. In case it could be carried out in another language it will be indicated before starting the contracting procedure. In order to access the services offered by the provider, the user must register through the website by creating a user account. To do so, the user must freely and voluntarily provide the personal data that will be required. The user will select a user name and password, undertaking to make diligent use of them, and not to make them available to third parties, as well as to inform the provider of the loss or theft of the same or possible access by an unauthorized third party, so that it proceeds to the immediate blocking. The user will not be able to choose as user name words that have the purpose of confusing others by identifying him/her as a member of the provider, as well as offensive, insulting expressions and in general, contrary to the law or to the requirements of morality and good customs. Once the user account has been created, it is reported that in accordance with the requirements of art. 27 of Law 34/2002 of Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:

  1. To carry out the shopping cart. You must express the quantity of the product. The purchase must be more than 10 euros.
  2. Ordering method. The user must place the order as a guest or registered.
  3. Invoicing details. Selection of shipping address and delivery territory.
  4. Type of payment (Paypal) or Credit Card.
  5. Checking and placing the order. Click on “I have read and accept the conditions” to finish the contracting procedure.
  6. Payment information.

In any case, the provider’s contracting platform will inform the user, once the contracting procedure is completed, regarding all the characteristics, price, forms of transport, date of contracting and estimated delivery of the product or service contracted. Likewise, an e-mail will be sent to the user confirming his order. Proper access to the online store depends on the telecommunications system used and in particular the Internet network, so the Company is not responsible for interruptions, delays or service errors for reasons beyond its control, as well as those arising from the equipment and / or network connection of the Customer.

Delivery of orders

The delivery of orders will be made at the address freely designated by the user. In the event that at the time of receiving your order one or more of the products or services of your order are not available or are out of stock, it will unfortunately not be possible to fill your order completely. In this case, we reserve the right to choose between partial fulfillment of your order and complete rejection of your order. In this case, we will inform you immediately by e-mail. The provider assumes no responsibility for when the delivery of the product or service does not take place as a result of the data provided by the user are false, inaccurate or incomplete or when the delivery can not be made for reasons beyond the shipping company, assigned for this purpose, such as the absence of the recipient. Notwithstanding the foregoing, the provider shall take the measures required of a diligent merchant so that delivery can be made within the agreed time, and if not, as soon as possible, to the satisfaction of the sender and the recipient, so that no liability can be imputed against the provider.

 

Price and period of validity of the offer

All prices indicated for the goods in the online store are understood to include the current value added tax and any expenses that may be applicable and in any case shall be expressed in the Euro currency (€). The prices applicable to each product/service will be those published on the website and will be applied automatically by the contracting process in the last phase of the same. The customer assumes that in any case the economic valuation of some of the products may vary in real time. In any case this will always be previously communicated to the users. Any payment made to the provider will entail the issuance of an invoice in the name of the registered user at the end of the purchase process. This invoice may be automatically sent to the e-mail address provided by the user, as well as sent together with the purchased product, when the user needs it. In any case, the order number assigned to you and indicated in the purchase confirmation e-mail must be indicated in the subject line of the message or to the telephone operator.

Methods of payment

As for the reservation of title, until payment of the full price, the delivered goods will remain the property of BarcelonArt of Travel. The payment will be made in advance with PayPal (prior registration, your bank or credit card details will be deposited with PayPal). We inform you that, according to the conditions that you have stipulated with credit institutions or other institutions, you may incur additional costs in terms of transfer fees, account management, etc.. We recommend that you check with your bank or credit card issuer in this regard. The Provider undertakes and provides that no charge will be made at any time for the use of the aforementioned means of payment. We reserve the right to individually restrict the use of the above payment methods to one or more options. We use secure payment systems of leading financial institutions in e-commerce. The payment data are confidential and are transmitted in encrypted form (SSL) to the corresponding financial institution. Payment by credit card has an order processing time of 48 hours.

Right of withdrawal

The user will have a period of 14 calendar days from the date of receipt of the product to return it. Not applicable to products sold “in bulk or by the metre”, such as fabrics, unless a complete piece is purchased. Unless the return is made due to defects in the product, the costs related to shipping will be borne by the user. In any case the product must be returned in its original packaging and in perfect condition. In the event of a valid notice of withdrawal or revocation, the services received and any benefits obtained (e.g. interest) shall be mutually returned. If it is not possible for the purchaser to return the received services in whole or in part, or only in deteriorated condition, the purchaser is obliged to compensate BarcelonArt of Travel to the corresponding extent.

Applicable warranties

All of them have the warranty period according to the criteria and conditions described in the Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

Data protection

BarcelonArt of Travel is responsible for the online store for the purposes of the regulations on the protection of personal data and the regulations on electronic commerce. We will use your data only as provided by law and on the basis of your consent, especially if it concerns data related to the receipt and fulfillment of your order (e.g. name, address, e-mail address, information about the ordered/purchased items, data about your ordering and payment behavior), as well as any other data that you voluntarily provide us with.

Applicable Law and Jurisdiction

These conditions shall be governed by or construed in accordance with Spanish law in that which is not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of products or services covered by these Conditions to the Courts and Tribunals of Province: Barcelona.

Cancellation of the reservation by the client:

– 1 week before return 100% money

– Less than one week before return 75% money

– 48 hours before return = 0

The Agency reserves the right to suspend or modify the activity when weather and safety conditions require it. Cancellation experience due to weather conditions, the client has the option of:

– Voucher for the next 6 months

– 100% money back
